1. Intellectual Property Rights

The Service and its original content, features, functionality, and all materials available on the site, including but not limited to text, graphics, logos, and the digital PoolPlans ("Plans"), are and will remain the exclusive property of PoolPlans and its licensors. Our intellectual property is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without prior written consent.

2. License to Use PoolPlans

Upon purchase, PoolPlans grants you a limited, non-exclusive, non-transferable license to use one (1) copy of the purchased Plan for the sole purpose of constructing one (1) swimming pool.

You are expressly prohibited from:

• Reselling, redistributing, or sub-licensing the Plans
• Using a single Plan purchase to construct more than one pool
• Modifying the Plans to create derivative works for sale or distribution
• Displaying the Plans publicly or on any other website
• Claiming ownership or authorship of the Plans

3. Critical Disclosures & Acknowledgement of Responsibility

• No Professional Engineering Services Rendered: PoolPlans is a design service only. Plans are not stamped by a licensed professional. A local engineer must review and approve.
• Local Code & Permit Compliance: You are responsible for ensuring compliance with local building codes and regulations.
• Builder & Contractor Responsibility: Builders are responsible for interpretation and proper execution of Plans.
• Site-Specific Conditions: Plans do not account for soil, seismic, climate, or environmental factors.
• No Warranty: Plans are provided "AS IS" without any express or implied warranty.

4. Purchases and Payments

All purchases are processed via third-party payment services. Prices are subject to change without notice.

Refund Policy: Due to the digital nature of our Products, all sales are final. No refunds, returns, or exchanges once the plan download link is provided.

5. Limitation of Liability

PoolPlans, its employees, partners, agents, or affiliates shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits or property, resulting from your use or inability to use the Service or Plans. Total liability is limited to the amount paid for the specific Plan.

6. Indemnification

You agree to indemnify and hold harmless PoolPlans, its licensors, employees, contractors, and directors from any claims, damages, or expenses arising from your use of the Service or Plans.

7. Governing Law

These Terms shall be governed by the laws of the State of Texas, United States, without regard to its conflict of law provisions.

8. Changes to Terms

We reserve the right to modify or replace these Terms at any time. Notice will be provided by posting the updated Terms and Conditions on this page and updating the "Last Updated" date.
